The terms ‘Lakeside’, ‘Lakeside Tree Nursery’, ‘the nursery’, ‘us’ or ‘we’ refer to the owner of the website whose registered address is at Leaworks House, 10 Ronald Street, Nottingham, NG7 3GY and trading address at Lakeside Tree Nursery, Eaton Lake Farm, Barton Lane, Attenborough, Beeston, Nottingham, NG9 6DY.

The content of this website's pages is for your general information and use only. It is subject to change without notice. The sizes of the plants are approximate and can change without notice. For example, a height might be stated on our website; thereafter, the plants may have been pruned to improve their quality and supplied shorter than described on our website.

We don’t provide any warranty or guarantee on the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. While we make every effort to provide plants that are true to the variety name, errors in plant identification or labelling can occur.

You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements. For example, you are responsible for choosing the right plants that are suitable for your planting location, and we will not be liable for any advice provided in helping you make your selection.

This website contains material which is owned by us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited.

Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Scotland and Wales.

Unless purchased separately and explicitly for the purpose, we don’t provide any warranty or guarantee for the plants.

We will not be liable for any damages caused by delays in transit caused by the courier and we cannot guarantee that deliveries will be made during the requested time slots.

Once you receive your plants, please check them carefully and notify us of any discrepancies, issues with quality of the plants or deficiencies within 7 days of receipt of the plants. If no such notifications are received within 7 days, you will have accepted receipt of the order as complete and accurate.

Payment

Payment for goods and delivery can be made by any method shown on our website when you place your order. Your order will be collected locally or dispatched for delivery when payment has been received, and funds are cleared. All card payments are made through third-party payment transaction companies and we, therefore, do not have access to your card or bank details.

Delivery

Collection of items in stock is welcomed. Please get in touch with us to confirm a collection date.

We make every effort to ensure we deliver the goods as soon as possible after receiving your order. Out-of-stock items will go on back order, and we will notify you when they become available and confirm a delivery date with you.

Costs and couriers:

Delivery charges will depend on the weight and dimensions of the goods you order and the location of the delivery address. Due to the size of the plants, most of them will be dispatched by pallet deliveries such as National Pallet and can take up to 3-5 working days to arrive. This is an approximation of a realistic lead time, yet we will, of course, endeavour to deliver your order to you as soon as possible and convenient to you.

For areas near Nottingham, a full pallet delivery cost will start from £40, while for areas such as Highland in Scotland, the delivery cost can be up to £200 per pallet. For certain items bigger than a pallet size, a dedicated lorry can be arranged, and the price will start from a few hundred pounds as per the delivery company's quote.

Refund/Order cancellation

All plants are checked by highly trained staff at the nursery before dispatch, but in the unlikely event that you are dissatisfied with your order, please get in touch. Under distance selling regulations (The Consumer Contracts Regulations 2013), you are allowed to return items that have not been planted in the ground in good condition. Items must be returned to Lakeside Tree Nursery within 7 working days of receipt of your order for a refund (excluding delivery and return costs). You will be responsible for returning the goods to us at your own expense. You must ensure that the goods are returned to us in saleable condition. If items returned to us are damaged and cannot be restocked we will not be able to make a refund to you. The refund will be made via the same payment method used to make the purchase.

If there is a problem with the goods please get in touch with us as soon as possible.

This returns policy does not affect your statutory rights.

Complaints

If you are not completely satisfied, Lakeside Tree Nursery must be notified in writing (via email: store@lakeside.co.uk) within 7 days of receipt of the trees. Failure to do so will deem those goods as being accepted.

Force Majeure

In the event that Lakeside Tree Nursery is prevented from carrying out its obligations under a contract for sale as a result of any cause beyond its control, such as but not limited to Acts of God, War, Strikes, Lock outs, Flood and Failure of third parties to deliver goods, Lakeside Tree Nursery shall be relieved of its obligations and liabilities under such contract for sale for as long as such fulfilment is prevented.
